AAAVerify.com uses the information contained in the NAIC Biographical Affidavit as a tool to perform an independent third-party verification to determine an individual’s fitness and propriety. AAAVerify.com’s biographical verification may contain information bearing on the Affiant’s character, general reputation, personal characteristics, mode of living and credit standing (as required). AAAVerify.com uses the independent third-party verification to create a background report (the “Background Report”).

Background Reports are subject to the Fair Credit Reporting Act (“FCRA”), 15 U.S.C § 1681, as amended. Pursuant to the FCRA, you are considered an “Applicant Company” that is a “user” of consumer reports. The FCRA requires that the Applicant Company provide the Affiant with the enclosed copy of “Summary of Your Rights Under the Fair Credit Reporting Act.” In the event of multiple Affiants, you should provide a copy of the “Summary of Your Rights Under the Fair Credit Reporting Act” to each Affiant. This summary can be found on the website of the Federal Trade Commission (“FTC”):

Background Reports are valid from six months from the signature date of the affidavit. Any alteration to the original biographical affidavit or updated signature will require a newly prepared background report. AAAVerify.com retains evidence for five years, or to the extent required by law.

Per FCRA § 6.4(b), You are required to obtain separate, clear, and conspicuous written disclosure if information from the consumer report will be used for employment purposes. You further are prohibited from using any information in the Background Report in violation of any applicable Federal or State Equal Employment Opportunity laws or regulations when the Background Report is used for employment purposes.

You are required to comply with the FCRA, especially as it relates to the confidentiality of the information contained in such consumer reports. To the extent required by law, you should maintain any Background Reports as Confidential.
